Acceptance of the General Terms and Conditions of Sale

These General Terms and Conditions of Sale govern the contractual relationship between Le RF and any non-trading individual wishing to make a purchase on lerougefrancais.com. In this context, the buyer and the seller agree that these General Terms and Conditions of Sale, together with the order as accepted by the company, the Website Terms of Use and the Privacy Policy, exclusively govern their relationship.

Amendments to the General Terms and Conditions of Sale

Le RF reserves the right to amend these General Terms and Conditions of Sale unilaterally and at any time. Any amendments to the General Terms and Conditions of Sale shall apply to all orders placed after the amended terms have been published online.

These General Terms and Conditions of Sale contain important information, particularly regarding warranties and limitations of liability. You acknowledge that you have read and accepted them.

Definitions and Application

In these General Terms and Conditions of Sale, “Le RF” means Le Rouge Français, “you” means the buyer placing an order on this website, and “Products” means Le RF products available for order on lerougefrancais.com.
The purchase of a Product from this website implies the buyer’s full and unconditional acceptance of these General Terms and Conditions of Sale, which apply to all purchases delivered within the European Union and worldwide.

Geographical Area

Online sales of the Products presented on the website are reserved for buyers residing within the European Union and requesting delivery within this geographical area.

Products

The products governed by these General Terms and Conditions of Sale are those displayed on the Le RF website, accessible at lerougefrancais.com. Products are offered subject to availability.

Le RF will make every effort to ensure that the photographic representation of the Products is as accurate as possible. However, the appearance of the Products on your own screen may not exactly correspond to the actual Product.

Prices and Payment

The prices displayed on this website are net prices payable (VAT not applicable pursuant to Article 293 B of the French General Tax Code). Prices may be changed at any time; however, the price displayed on the website on the date the order is placed shall be the only price applicable to the buyer.
The amount payable to Le RF for an order is the sum of the prices of each Product ordered, as indicated on the website on the date of the order (Product Subtotal), together with the applicable delivery charges.
Payment is due at the time the order is placed. Payments may be made by bank card or PayPal through the secure PayPal and BNP platforms. The information transmitted is encrypted by software and cannot be accessed by any third party while being transmitted over the network.
For certain European Union countries, you may be required to pay applicable import taxes.

Orders are placed through the Shopify platform via lerougefrancais.com.

Liability

As part of the online sales process, the seller is subject only to an obligation of reasonable endeavours and shall not be held liable for damage resulting from the use of the Internet, including loss of data, intrusion, viruses, service interruptions or other unintentional issues.

If you fail to pay for your order in accordance with these General Terms and Conditions of Sale, Le RF reserves the right to:

a. postpone Delivery and return the Products included in the order to stock; and/or
b. cease conducting business with you, and Le RF shall not be liable to you for any loss or damage resulting from such action.

You are responsible for determining whether the Products are suitable for your intended use.
Subject to the “Warranty” clause below and within the limits permitted by law, Le RF’s liability for any failure to fulfil its obligations under these General Terms and Conditions of Sale or any other applicable legal provisions (including defects inherent in the Product) shall be limited to the refund or replacement of the Products concerned.

Warranty

The Products are not covered by any commercial warranty within the meaning of Articles L. 211-15 et seq. of the French Consumer Code.

The Products benefit from the statutory warranty provided for under Articles 1641 et seq. of the French Civil Code and Articles L. 211-4 et seq. of the French Consumer Code.

In the event that a Product sold is non-compliant within the meaning of these provisions, it may be returned to the seller free of charge and will be replaced. Failing this, the provisions of Article L. 211-10 of the French Consumer Code shall apply, which state:

“If repair and replacement of the goods are impossible, the buyer may return the goods and obtain a refund of the purchase price, or retain the goods and obtain a partial refund.

The buyer shall have the same option:

1° If the solution requested, proposed or agreed pursuant to Article L. 211-9 cannot be implemented within one month following the buyer’s complaint;

2° Or if such solution cannot be implemented without causing major inconvenience to the buyer, taking into account the nature of the goods and their intended use.

However, the sale may not be rescinded if the lack of conformity is minor.”

Defective Products

In the event of a defective Product, the Customer must contact Le RF at contact@lerougefrancais.com and provide the corresponding proof of purchase, photographs showing the defect, and the batch number of the Product concerned.

Le RF reserves the right to request the return of the Product concerned for inspection.

The request will be processed after receipt and examination of the required information and, where applicable, of the returned Product, in accordance with the statutory warranty provisions set out above.

Right of Withdrawal

In accordance with Article L. 121-20 of the French Consumer Code, you have a right of withdrawal allowing you to return Products without having to provide any reason or pay any penalty. However, where the return of the Products is not due to a defect or an error on the part of Le RF, the return shipping costs shall remain at your expense.

You may exercise this right within 7 clear days from receipt of the Products.

If you exercise your right of withdrawal, you must return the Products ordered at your own expense, in new condition and suitable for resale, to the address that will be provided to you.

Le RF will issue the refund within 30 days following the exercise of the right of withdrawal.

Refunds and Returns

Only items purchased from the Le RF website (lerougefrancais.com) may be returned to Le RF for a refund or exchange. Items purchased from a department store, retailer or any other point of sale must be returned to the original point of purchase.

If you purchased the wrong Product on our website, Le RF will exchange it for the Product you intended to purchase. The returned Product must be unopened and in perfect resale condition. Shipping and return costs are at your expense.

If the use of one of our Products has caused skin irritation, you may exchange it or request a refund.

Products must be returned to the company. Return shipping costs are borne by the Customer.

In France, shipping costs will be charged if a partial refund of the original order reduces its total amount below the threshold required to qualify for free delivery.

If an item is damaged during transport between Le RF and the delivery address, it will be exchanged or refunded by Le RF. Return shipping costs will be reimbursed if the Products delivered do not comply with the Order, if the Products are damaged during transport, or if they are defective.

In all cases, original proof of purchase must be provided and the Products must be returned within 14 days of receipt of the order in order for Le RF to process any refund or exchange. Please email contact@lerougefrancais.com before returning a Product so that our team can assist you with the procedure. We recommend keeping the receipt provided by the carrier until you have confirmation that your parcel has been received by Le RF. We may ask you to provide it if we do not receive your parcel.

We will endeavour to process returns within 10 business days of receipt. Refunds will be issued using the payment method originally used for the purchase.

Shade Exchange

If the shade ordered exclusively through our website does not meet your expectations, you may benefit from one complimentary exchange for another shade of the same Product and from the same collection, once per item ordered and subject to availability.

This offer is available exclusively in mainland France and must be requested within fourteen (14) days of receipt of your order.

To benefit from this service, simply contact our Customer Service team, providing your order number and the reference of the new shade you would like. A printable return label will then be sent to you by email.

The returned Product must be sent back in its original packaging and must only have been used for the purpose of testing the shade. Once the return has been received and approved by our team, the newly selected shade will be dispatched.

This service is exclusively available for exchanging the shade of the same Product and cannot be used to exchange it for another Product, receive store credit or obtain a refund. This offer cannot be combined with a promotional code or any other additional discount.

Offer Terms – Complimentary Signature Hair Clips

From September 1 to September 30, 2026 inclusive, Le Rouge Français Signature Hair Clips are offered complimentary with any purchase of at least €75 including VAT.

Offer valid while stocks last on lerougefrancais.com and at our Le Rouge Français boutique located at 16 rue de Turenne, 75004 Paris.

The €75 including VAT threshold is calculated based on the value of the Products actually purchased, after the application of any discounts or promotional codes.

In the event of a full or partial return of an order that benefited from this offer, if the value of the Products retained falls below €75 including VAT, the complimentary Signature Hair Clips must also be returned, complete and in their original condition.

If the complimentary Product is not returned, Le Rouge Français reserves the right to deduct its retail value from the refund amount, within the limits permitted by applicable regulations.

Force Majeure

If Le RF is delayed or unable to fulfil its obligations under an order due to an unforeseeable event beyond its control, Le RF shall not be held liable, and the period for fulfilling its obligations shall be extended for the duration of the event considered to constitute force majeure.

Personal Data

The information you provide in connection with your Product order will be processed electronically. The website is hosted on the Shopify platform.

Applicable law: These online General Terms and Conditions of Sale are governed by French law. Any dispute relating to their performance or interpretation shall fall within the jurisdiction of the courts of Paris, subject to any applicable mandatory rules of law.

The information contained in this document concerns the online retail website operated by Le Rouge Français.

Delivery

Products can be delivered to mainland France, Corsica, Monaco and Europe, to the address of your choice as provided during the ordering process. You are responsible for providing us with all the information required to ensure the proper delivery of your order.

Depending on the offer, we may provide different delivery services. Your contribution to shipping costs depends on the delivery method selected and will be displayed during the Delivery stage of the online ordering process before the order is confirmed.

Depending on the delivery service selected, your order will be delivered within 2 business days from confirmation of your order if it is confirmed before 2:00 p.m., Monday to Friday. Your order will be delivered no later than 10 business days after confirmation.

Home Delivery and Pick-Up Point Delivery – France and Monaco

The flat-rate delivery charges applicable to home delivery or pick-up point delivery in mainland France and Monaco are displayed when the order is confirmed on the website.

Delivery is free above the minimum purchase amount specified on lerougefrancais.com (rates and conditions may be changed at any time).

Orders may be delivered via Mondial Relay to the pick-up point selected by the Customer when confirming the order. Delivery times are provided for information purposes at the time of purchase and may vary depending on the destination, periods of high activity or carrier constraints. The Customer will be informed that the parcel is available for collection by email and/or any other notification method offered by the carrier.

The parcel must be collected within the period specified by Mondial Relay. If it is not collected within the applicable timeframe, it will be returned to the sender.

In this case, the Customer may:

– request that the order be resent, subject to payment of a flat-rate contribution of €4 including VAT towards reshipping costs; or
– request a refund of the order.

The refund will only be issued once the returned parcel has actually been received by the sender. In this case, only the value of the Products ordered will be refunded. The initial delivery charges will not be refunded and will remain payable by the Customer as a result of the parcel not having been collected.

This provision applies outside the exercise of the right of withdrawal, which remains governed by the provisions set out in the section of these General Terms and Conditions of Sale relating to the right of withdrawal.

International Delivery

Shipping costs for home delivery within and outside Europe can be viewed using the calculator available before the order is confirmed. Additional charges may be requested by the carrier before the parcel is delivered, depending on the import duties and taxes applicable in the destination country.

PROTECTION OF PERSONAL DATA ON THE WEBSITE

As originally designed, the lerougefrancais.com website is not intended to collect personal data relating to its visitors. The only personal information recorded is information voluntarily provided by users who complete the contact form. No personal information may be transferred to third parties or commercial companies.
