Acceptance of the Terms and Conditions of Sale

These Terms and Conditions of Sale govern the contractual relationship between Le RF and any individual acting for non-commercial purposes who wishes to make a purchase on lerougefrancais.com. In this context, the buyer and the seller agree that these Terms and Conditions of Sale, together with the order as accepted by the company, the Website Terms of Use and the Privacy Policy, exclusively govern their relationship.

Amendments to the Terms and Conditions of Sale

Le RF reserves the right to amend these Terms and Conditions of Sale unilaterally at any time. Any amendments shall apply to orders placed after the amended Terms and Conditions of Sale have been published online.

These Terms and Conditions of Sale contain important information, particularly regarding warranties and limitations of liability. By placing an order, you acknowledge that you have read and accepted them.

Definitions and Scope

In these Terms and Conditions of Sale, “Le RF” means Le Rouge Français, “you” means the buyer placing an order on this website, and “Products” means Le RF products available for purchase on lerougefrancais.com.
The purchase of a Product through this website implies the buyer’s full and unconditional acceptance of these Terms and Conditions of Sale, which apply to purchases delivered within the European Union and worldwide.

Geographical Area

Online sales of the Products presented on the website are reserved for buyers residing within the European Union and requesting delivery within this geographical area.

Products

The Products governed by these Terms and Conditions are those displayed on the Le RF website, accessible at lerougefrancais.com. Products are offered subject to availability.

Le RF will make every effort to ensure that the photographic representation of the Products is as accurate as possible. However, the appearance of the Products on your screen may differ slightly from the actual Product.

Prices and Payment

The prices displayed on this website are net prices payable (VAT not applicable pursuant to Article 293 B of the French General Tax Code). Prices may be changed at any time; however, the price displayed on the website on the date the order is placed shall be the price applicable to the buyer.
The amount payable to Le RF for an order consists of the total price of each Product ordered, as displayed on the website on the date of the order (Product Subtotal), together with any applicable delivery charges.
Payment is due at the time the order is placed. Payments may be made by bank card or PayPal through the secure PayPal and BNP payment systems. Information transmitted during payment is encrypted and cannot be accessed by third parties while being transmitted over the network.
For certain European Union countries, you may be required to pay applicable import taxes.

Orders are placed through the Shopify platform via lerougefrancais.com.

Liability

In the online sales process, the seller is bound only by a best-efforts obligation and shall not be held liable for damage resulting from the use of the Internet, including loss of data, intrusion, viruses, service interruptions or other unintended issues.

If you fail to pay for an order in accordance with these Terms and Conditions of Sale, Le RF reserves the right to:

a. postpone delivery and return the Products included in the order to stock; and/or
b. cease doing business with you, without Le RF being liable for any loss or damage resulting from such action.

You are responsible for determining whether the Products are suitable for your intended use.
Subject to the “Warranty” clause below and within the limits permitted by law, Le RF’s liability for any failure to comply with its obligations under these Terms and Conditions of Sale or other applicable legal provisions (including defects inherent in the Product) shall be limited to the refund or replacement of the Products concerned.

Warranty

The Products do not benefit from any commercial warranty within the meaning of Articles L. 211-15 et seq. of the French Consumer Code.

The Products benefit from the statutory warranties provided for under Articles 1641 et seq. of the French Civil Code and Articles L. 211-4 et seq. of the French Consumer Code.

In the event that a Product sold is non-compliant within the meaning of these provisions, it may be returned to the seller free of charge and replaced. Failing this, Article L. 211-10 of the French Consumer Code shall apply, under which:

“If repair and replacement of the goods are impossible, the buyer may return the goods and obtain a refund of the purchase price, or retain the goods and obtain a partial refund.

The same option is available:

1° If the solution requested, proposed or agreed pursuant to Article L. 211-9 cannot be implemented within one month following the buyer’s complaint;

2° Or if such solution cannot be implemented without causing significant inconvenience to the buyer, taking into account the nature of the goods and their intended use.

However, cancellation of the sale may not be ordered where the lack of conformity is minor.”

Defective Products

In the event of a defective Product, the Customer must contact Le RF at contact@lerougefrancais.com and provide the corresponding proof of purchase, photographs clearly showing the defect and the batch number of the Product concerned.

Le RF reserves the right to request that the Product concerned be returned for inspection.

The request will be processed upon receipt and examination of the necessary information and, where applicable, the returned Product, in accordance with the statutory warranty provisions set out above.

Right of Withdrawal

In accordance with Article L. 121-20 of the French Consumer Code, you have a right of withdrawal allowing you to return Products without having to provide a reason or pay a penalty. However, where the return is not due to a defect or an error on the part of Le RF, the return shipping costs shall remain at your expense.

You may exercise this right within seven (7) clear days from receipt of the Products.

If you exercise your right of withdrawal, you must return the Products ordered at your own expense, in new condition and suitable for resale, to the address that will be provided to you.

Le RF will issue the refund within thirty (30) days following the exercise of the right of withdrawal.

Refunds and Returns

Only items purchased through the Le RF website (lerougefrancais.com) may be returned to Le RF for a refund or exchange. Items purchased from a department store, retailer or any other point of sale must be returned to the original point of purchase.

Regardless of the reason for the return, the Product must be returned unopened, unused and in its original condition. Only Products returned as part of a shade exchange may have been opened or tested, in accordance with the conditions applicable to this offer.

If you wish to exchange a Product purchased on our website for another Product, both the shipping and return costs shall be at your expense.

If the use of any of our Products causes a skin reaction, the Customer is invited to submit a claim to Le Rouge Français in order to report the reaction experienced.

To enable the claim to be assessed, Le Rouge Français may ask the Customer to follow a verification procedure and provide the information necessary to document the reaction and the conditions under which the Product was used, including the Product references and batch number, any relevant information regarding its use and, where necessary, the opinion or assessment of a healthcare professional.

Following the assessment of the claim, and provided that the claim is deemed admissible, Le Rouge Français may, depending on the circumstances, offer an exchange of the Product concerned or a refund.

Products must be returned to the company. The cost of returning the Products shall be borne by the Customer.

In France, shipping costs will be charged if a partial refund of the original order reduces the order value below the threshold required to qualify for free delivery.

If an item is damaged during transport between Le RF and the delivery address, it will be exchanged or refunded by Le RF. Return shipping costs will be refunded if the Products delivered do not conform to the Order, are damaged during transport or are defective.

In all cases, original proof of purchase must be provided and the Products must be returned within fourteen (14) days of receipt of the order in order for Le RF to process any refund or exchange. Please email contact@lerougefrancais.com before returning a Product so that our teams can assist you with the return procedure. We recommend keeping proof of postage until you have confirmation that your parcel has been received by Le RF. We may ask you to provide this proof if we do not receive your parcel.

We will endeavour to process returns within ten (10) business days of receipt. Refunds will be issued using the payment method used for the original order.

Shade Exchange

If the shade ordered exclusively through our website does not meet your expectations, you may benefit from one complimentary exchange for another shade of the same Product and collection, once per item ordered and subject to availability.

This offer is available exclusively in Metropolitan France and must be requested within fourteen (14) days following receipt of your order.

To benefit from this service, simply contact our Customer Service team, providing your order number and the reference of the new shade you would like. A printable return label will then be sent to you by email.

The returned Product must be sent back in its original packaging and must only have been used for the purpose of testing the shade. Once the return has been received and approved by our team, the selected replacement shade will be shipped.

This service is exclusively available for the exchange of a shade of the same Product and cannot be used to exchange the item for another Product, store credit or a refund. This offer cannot be combined with a promotional code or any other additional discount.

Offer Terms – Complimentary Signature Hair Clips

From September 1 through September 30, 2026 inclusive, Le Rouge Français Signature Hair Clips are offered free of charge with any purchase of at least €75 including VAT.

The offer is valid while stocks last on lerougefrancais.com and at our Le Rouge Français boutique located at 16 rue de Turenne, 75004 Paris.

The €75 including VAT threshold is calculated based on the value of the Products actually purchased after the application of any discounts or promotional codes.

In the event of a full or partial return of an order that benefited from the offer, if the value of the Products retained falls below €75 including VAT, the complimentary Signature Hair Clips must also be returned, complete and in their original condition.

If the complimentary Product is not returned, Le Rouge Français reserves the right to deduct its retail value from the amount refunded, to the extent permitted by applicable law.

Force Majeure

If Le RF is delayed or prevented from performing its obligations under an order due to an unforeseeable event beyond its control, Le RF shall not be held liable and the time allowed for performance shall be extended for the duration of the event constituting force majeure.

Personal Data

The information you provide in connection with your Product order will be processed electronically. The website is hosted on the Shopify platform.

Applicable Law: These online Terms and Conditions of Sale are governed by French law. Any dispute relating to their performance or interpretation shall fall within the jurisdiction of the courts of Paris, subject to any mandatory rules of applicable law.

The information contained in this document relates to the online retail website operated by Le Rouge Français.

Delivery

Products may be delivered to Metropolitan France, Corsica, Monaco and Europe, to the address of your choice as provided during the ordering process. You are responsible for providing all information necessary to ensure the proper delivery of your order.

Depending on the offers available, different delivery services may be proposed. Your contribution to shipping costs depends on the delivery method selected and will be displayed during the Delivery stage of the online checkout process before the order is confirmed.

Depending on the delivery service selected, delivery may take place within two (2) business days following confirmation of your order, provided the order is confirmed before 2:00 p.m. Monday through Friday. Delivery will take place no later than ten (10) business days after confirmation of your order.

Home Delivery and Pickup Point Delivery – France and Monaco

The flat-rate delivery charges applicable to home and pickup point deliveries in Metropolitan France and Monaco are displayed on the website when the order is confirmed.

Delivery is free above the minimum purchase amount specified on lerougefrancais.com (rates and conditions may be amended at any time).

Orders may be delivered via Mondial Relay to the pickup point selected by the Customer when confirming the order. Delivery times are provided for information purposes at the time of purchase and may vary depending on the destination, periods of high activity or carrier constraints. The Customer will be informed that the parcel is available for collection by email and/or any other notification method offered by the carrier.

The parcel must be collected within the period specified by Mondial Relay. If the parcel is not collected within the specified period, it will be returned to the sender.

In such circumstances, the Customer may:

– request that the order be reshipped, subject to payment of a flat-rate €4 including VAT reshipping fee; or
– request a refund of the order.

A refund will only be issued once the returned parcel has actually been received by the sender. In this case, only the value of the Products ordered will be refunded. The original delivery charges will not be refunded and shall remain payable by the Customer due to the Customer’s failure to collect the parcel.

This provision applies outside the exercise of the right of withdrawal, which remains governed by the provisions set out in the section of these Terms and Conditions relating to the right of withdrawal.

International Delivery

Shipping costs for home delivery within and outside Europe can be viewed using the calculator available before the order is confirmed. Additional charges may be requested by the carrier before delivery of the parcel depending on the import duties and taxes applicable in the destination country.

Le Club Loyalty Program

1. Purpose and Conditions of Participation

LE ROUGE FRANÇAIS offers its customers a free loyalty program that enables members to earn points and access rewards and benefits.

The program is open to any individual who has a customer account on www.lerougefrancais.com and has accepted these terms and conditions. Membership is personal and intended exclusively for non-professional use. Only one loyalty account is permitted per person.

The program is exclusively accessible and available online at www.lerougefrancais.com in all countries to which LE ROUGE FRANÇAIS delivers.

It is not available in LE ROUGE FRANÇAIS physical stores. Purchases made in stores therefore do not earn points, and rewards and benefits offered through the program cannot be redeemed in stores.

2. Earning and Validity of Points

Members may earn points through purchases and through the various actions or missions offered in their loyalty account. The applicable earning rates and conditions for each action are specified on the dedicated program page and/or in the member’s loyalty account.

For eligible purchases, points are calculated based on the order amount excluding taxes, excluding delivery charges and before the application of any discounts, reductions or promotional codes.

Points earned from a purchase are credited once the order has been confirmed.

Points are valid for twelve (12) months from the date on which they are earned, with each allocation of points having its own expiration date. After this period, the relevant points will expire and be permanently forfeited.

Points are personal, have no monetary value and may not be sold, transferred, exchanged for cash or refunded.

LE ROUGE FRANÇAIS may occasionally offer promotions allowing members to earn additional points or may apply specific earning rates, subject to the conditions communicated to members.

3. Returns, Cancellations and Refunds

In the event of the cancellation, return or full refund of an order, the points earned from that order will be cancelled and deducted from the member’s loyalty account.

In the event of a partial return or refund, only the points corresponding to the Products or amounts concerned will be deducted.

If the relevant points have already been redeemed, LE ROUGE FRANÇAIS reserves the right to adjust the member’s points balance and, where applicable, any benefits obtained using those points.

The deduction of points following a cancellation, return or refund may also result in the member’s status being recalculated.

4. Rewards and Benefits

Points provide access to the rewards and benefits displayed on the program page and/or in the member’s loyalty account.

The number of points required and any applicable conditions of use are specified for each reward.

The validity period of rewards varies according to their nature and is communicated to the member when the reward is obtained and/or displayed in the member’s loyalty account. An expired reward can no longer be used.

Rewards are personal and non-transferable and may not be exchanged for cash or any other financial consideration. Rewards consisting of Products or gifts are offered subject to availability.

Any conditions relating to the combination of rewards with other offers or promotions are specified for each reward.

5. Program Tiers

The loyalty program includes three tiers determined by the number of points accumulated:

Essentiel: 0 to 150 points;

Signature: 151 to 300 points;

Exceptionnel: 301 points and above.

Once a member reaches a tier, that tier is retained for twelve (12) months from the date on which it is achieved.

Redeeming points for a reward does not result in an immediate change of tier, even if the member’s available points balance subsequently falls below the threshold applicable to that tier.

At the end of the twelve-month period, the member’s tier will be reassessed based on their activity during the previous twelve months. The tier may be maintained, upgraded to a higher tier or downgraded to a lower tier.

As an exception, where a cancellation, return or refund results in the deduction of points that contributed to the member reaching a particular tier, the member’s tier may be recalculated immediately without waiting for the anniversary date.

The benefits associated with each tier are displayed on the dedicated program page and/or in the member’s loyalty account. They may be changed in accordance with the conditions set out below.

6. Referral Program

The loyalty program allows members to refer new customers in accordance with the terms displayed in their loyalty account.

The referred customer may receive a benefit to use on their first order. The referring member may also receive a benefit when the referred customer places their first eligible order.

The nature, amount, validity period and conditions of use of referral benefits are those displayed on the program page and/or in the loyalty account at the time of the referral.

Referrals are personal. Self-referrals, the creation of multiple accounts or any misuse of the referral program for the purpose of improperly obtaining benefits are prohibited.

In the event of cancellation, return or refund of the order that resulted in the award of a referral benefit, LE ROUGE FRANÇAIS reserves the right to cancel or adjust the corresponding benefit.

7. Use of the Program and Account Closure

Any fraud, attempted fraud, creation of multiple accounts or misuse of the program may result in the suspension or termination of the loyalty account and the cancellation of any points or rewards obtained improperly.

LE ROUGE FRANÇAIS also reserves the right to correct a member’s points balance, rewards or tier in the event of a technical or administrative error.

If the customer account is closed, all unused points, rewards and benefits will be permanently forfeited.

8. Changes, Suspension or Termination of the Program

LE ROUGE FRANÇAIS reserves the right to modify the program, including point-earning rates, missions, rewards, benefits associated with each tier and referral terms.

In the event of a material change affecting members’ rights, members will be informed by any appropriate means within a reasonable period before the change takes effect, unless legal, regulatory, technical or security requirements require immediate implementation.

LE ROUGE FRANÇAIS may also suspend or terminate the program. In such circumstances, members will be informed within a reasonable period and, unless impossible or where there is a legitimate reason preventing it, will be given a period in which to redeem their accrued points and rewards.

9. Personal Data

Personal data processed in connection with the program is used in accordance with the LE ROUGE FRANÇAIS Privacy Policy, particularly for the purposes of managing membership, points, tiers, rewards and referrals.

Membership of the loyalty program does not automatically constitute consent to receive marketing communications where such consent is required under applicable law.

Legal Notice

PERSONAL DATA PROTECTION ON THE WEBSITE

The lerougefrancais.com website, as originally designed, is not intended to collect personal data from its visitors. The only personal information recorded is information voluntarily provided by users who complete the contact form. No personal information may be transferred to third parties or commercial companies.

Users are informed that they have the right to access, amend, rectify and delete data concerning them (Article 39 et seq. of the French Data Protection Act of January 6, 1978 – “Informatique et Libertés”). These rights may be exercised by contacting: contact@lerougefrancais.com.
